The N.C. Court of Appeals has ruled that contracting parties cannot shorten the four-year statute of limitations for Unfair and Deceptive Trade Practices Act (UDTPA) claims. As Smith Anderson attorneys Andrew Atkins and Tess S. R. Diven explain in this legal alert, the three-judge panel acknowledged that North Carolina has allowed parties to contractually shorten limitations periods, but the legislative purpose of the UDTPA to protect consumers from unfair and bad faith dealing weighs heavier.
